Industry Circular 37 of 2025 - Publication of Financial Services (Prudential and Statistical Returns) (Amendment) Order, 2025

PUBLICATION OF FINANCIAL SERVICES (PRUDENTIAL AND STATISTICAL RETURNS) (AMENDMENT) ORDER, 2025

The BVI Financial Services Commission (the Commission) wishes to inform all Trust and Corporate Services Providers (TCSPs) that there has been an amendment to the Financial Services (Prudential and Statistical Returns) Order, 2009 (the Order).  

TCSPs should note that the Prudential Return for Fiduciary Services Business outlined in Schedule 3 of the Order has been revoked and replaced.  The new Schedule 3 provides an updated Trust and Corporate Services Provider Annual Return, which has been amended to enhance the Commission’s ability to identify, analyse, assess and manage risks associated with TCSPs.  

The Commission wishes to remind TCSPs that Returns are due annually by 31 January and filings for the 2025 reporting period are to be completed using the electronic version of the new Return. Effective January 2026, the existing form will no longer be accepted.  

The Order can be found here on the Commission’s website. The electronic Return and guidance on how to complete the new Return are also available under the ‘Annual Returns’ tab on the Commission’s Home page.

The Commission, therefore, expects all licensed TCSPs to take the necessary steps to familiarise themselves with the new Return and collect and submit the required data in order to fulfil their filing requirements by the 31 January 2026 deadline.
