ADVISORY WARNING

THE BELARUS (RESTRICTIVE MEASURES) (OVERSEAS TERRITORIES)

ORDER 2011 U.K.S.I. 2011 NO. 2440

 

Tortola, British Virgin Islands – 11 June, 2012 – The British Virgin Island Financial Services Commission (the “FSC”) is advising the public of the publication of The Belarus (Restrictive Measures) (Overseas Territories) Order, 2011. 

 

NOTICE IS HEREBY GIVEN that The Belarus (Restrictive Measures) (Overseas Territories) Order, 2006 has been revoked.

 

AND NOTICE IS FURTHER GIVEN of the Belarus (Restrictive Measures) (Overseas Territories) Order, 2011 (U.K.S.I. 2011 No. 2440) which has been amended by the Belarus (Restrictive Measures) (Overseas Territories) (Amendment) Order, 2011 (U.K.S.I. 2011 No. 2988) (collectively known as the “Belarus Orders”). These Belarus Orders give effect to measures adopted by the European Union in Council Decision 2010/639/CFSP which was adopted on 26 October, 2010, and amended on 20 June 2011 to add an arms embargo to the restrictive measure, and implemented in Council Regulation 765/2006, as amended from time to time, which came into force on 20 May, 2006. Council Decision 2010/639/CFSP repealed Common Position 2006/276/CFSP which had originally introduced the restrictive measures. The Belarus Orders continue restrictive measures in respect of Belarus and impose restrictive measures on individuals responsible for the failure to start independent investigations into the prosecution of certain crimes for the fraudulent elections and referendum in 2004 and for the violations of international electoral standards in the presidential elections in 2006 and 2010 and the crackdown on civil society and democratic opposition and those persons associated with them.

 

NOTICE IS FURTHER GIVEN that the measures in the Belarus Orders include a prohibition on the supply and delivery of arms and related material, the freezing of the funds and economic resources and a prohibition on making funds and economic resources available to persons or entities listed in Annex I and IA to the Council Regulation. AND NOTICE IS FURTHER GIVEN that in accordance with article 4 of the Belarus Orders, any person who, except under the authority of a licence granted by the Governor, supplies or delivers, agrees to supply or deliver, or does any act calculated to promote the supply or delivery of, restricted goods to any person or destination in Belarus is guilty of an offence unless they prove that they did not know and had no reasonable cause to suspect that the goods in question were supplied or delivered to a person or destination in Belarus.
